Conventional Warranty

Thank you for purchasing a Woodn Industries S.r.l. product

1. In accordance with the terms and conditions set forth hereto, Woodn Industries s.r.l. (hereinafter referred to as "WOODN") guarantees that the product to which this warranty is attached (hereinafter the "Product") complies in full with the technical specifications provided by WOODN, and is free from all flaws of design, material and workmanship.

2. This conventional warranty (hereinafter referred to as the "Warranty") is in favour of the buyer/user (hereinafter the "Customer") who has validly purchased ownership of the Product specified above, in accordance with the provisions of the specific contract.

3. This Warranty shall remain in valid for 5 (five) years as from the date of Customer purchase of the Product, as duly documented by the relevant invoice or receipt (or similar document of the same value in the country where the Product is purchased). The validity and enforceability of this Warranty shall in any case be subject to the Customer’s delivery to WOODN – along with the notice reporting the existence of the flaw in the Product as per paragraph 5 herein - of a copy of this Warranty duly signed by the Customer in every and each part.

4. This Warranty only covers original flaws in material or workmanship seen in normal use of the Product. It shall therefore not apply (without limitation) to any falws deriving from unforeseeable events, natural events, environmental conditions (air pollution, mould, mildew, etc.), staining, variations or changes in colour of the Product deriving from external elements, negligence, improper use, use or assembly of the Product not in compliance with the guidelines provided by WOODN, poor or improper storage, transport, treatment, assembly or installation by the Customer or any third party, insufficient or incorrect maintenance, normal wear and tear, modifications or alterations, repair and/or interventions by third parties without WOODN’s written consent, settling, movement, distortion or collapse of the supporting structure on which the Product is installed, as well as any other cause not ascribable to a patent flaw of the Product. In addition, any flaw in compliance of which the Customer was aware upon drawing up the contract, or which he could not fail to ignore in accordance with ordinary due diligence, shall not be considered as a flaw for the purposes of the Warranty.

Failure by the Customer (or any third parties not authorized by WOODN) to comply with the assembly, treatment and maintenance instructions of the Product, as well as the improper use, storage or transport of the Product, shall invalidated this Warranty.

5. The Customer shall forfeit this Warranty where, during the course of its validity, he should fail to report any original flaws of the Product within the terms of 2 (two) months as from the date on which such were discovered, or should have been discovered in accordance with ordinary due diligence. Within these terms, and at risk of forfeiture, the Customer must also notify the discovery of such flaws in writing to WOODN, by registered letter with advice of receipt sent to the following address: WOODN INDUSTRIES S.r.l., Viale Europa, n. 3, 35020 Ponte San Nicolò (PD) – ITALY and faxed ahead to +39.049.8960900.

6. Should Product flaws be reported by the Customer in a timely manner and in compliance with the provisions set out in the previous paragraphs herein, and should WOODN ascertain the existence of an original flaw in material or craftsmanship that is covered by this Warranty and not due to the Customer or any third party, WOODN will, at their own discretion, either repair or replace the flawed Product or flawed part thereof, free of charge. Alternatively, WOODN may reimburse the price paid by the Customer for the product, or the part of such found to be flawed.

7. In the event that the Product be transferred to a third party, be this for payment or free of charge, this Warranty shall remain valid for the remainder of the five year period as from the original date of purchase by the first buyer.

8. Should the Product or part thereof have been repaired or replaced under the terms of the previous paragraphs herein, this Warranty supplied by WOODN shall guarantee the start of a new warranty with a validity of a further 5 (five) years as from the date of repair and/or replacement. This shall apply exclusively with regard to the Product or part thereof that was affected by the original flaw and subsequently replaced.

9. This Warranty only applies to the Product represented, and is the only warranty granted by WOODN to the Customer. The Customer may not, therefore, in accordance with legal limits, claim any further specific or implied, legal or conventional warranty against WOODN, nor claim compensation for direct, indirect, incidental or consequential damages, either contractually or externally to such.

10. In no case shall WOODN's retailers, distributors, agents or employees be entitled to modify or extend this Warranty, nor to represent WOODN before the Customer or any third party.

11. This Warranty does not affect the rights pertaining to each consumer against the seller of the Product pursuant to applicable national and Community legislation concerning the sale of consumer goods.

12. This Warranty shall be governed by Italian law. Any dispute between WOODN and the Customer arising from this Warranty or in connection therewith, including any dispute concerning the existence of the conditions to which the validity and effectiveness of this Warranty is subject, shall be submitted to the exclusive jurisdiction of the Court of Padua, Italy.
